Welcome to Creative Minds Academy. We are committed to protecting the privacy of our customers and their children. This Privacy Policy explains how we collect, use, and safeguard your personal information when you visit our website, www.creativemindsacademy.nl, and enroll in our in-person classes.

For the purposes of the GDPR, Creative Minds Academy is the "Data Controller." The KVK number of the company can be found in the page footer.

2. Information We Collect

We only collect the minimum amount of information necessary to provide our services.

A. Information Provided by Parents/Guardians:
  • Contact Information: Name, email address, phone number, and billing address for the parent/guardian.

  • Student Information: Child’s name, age/date of birth, and languages spoken.

  • Sensitive Information: Health information, specifically allergies or medical conditions, required to ensure the safety of the child during in-person classes.

B. Information Collected Automatically:
  • Our website is hosted on the Wix.com platform. Wix uses cookies to provide security, monitor site performance, and improve your experience. (See Section 7 for more on Cookies).

C. Photos and Videos During Sessions:
  • We occasionally photograph children during our classes, workshops and promotional events.

  • When the child's face, or other immediately recognizable features, are not visible in the picture we do not consider those "Personally Identifiable Information" and exclude the material from the scope of this document.

  • For pictures where the child's face or other identifying information is visible, we provide the parents/guardians with a separate consent form outlining the permitted uses, retention policies, and opt-out conditions. We do not use or retain the images unless explicit consent is given.

3. How We Use Your Information

We process your data based on Contractual Necessity (to fulfill your booking) and Consent (for sensitive health data or marketing). Specifically, we use it to:

  • Process your registration and manage class attendance.

  • Communicate updates regarding scheduled classes or cancellations.

  • Ensure the safety of your child (medical/allergy info).

  • Send marketing emails, only if you have explicitly opted in.

4. Payment Processing

Payment for our classes is handled securely via Wix Payments.

  • We do not store your credit card or bank details.

  • All payment data is encrypted and handled by Wix in accordance with Payment Card Industry Data Security Standards (PCI-DSS).

5. Data Storage and Retention

We store your data in third-party storage systems, such as Wix and Google Workspace. Their terms of service obligate them to keep your data in secured servers. We take reasonable precautions to protect this data from unauthorized access.

We retain personal information only as long as necessary:

  • Attendance Records: Kept for 1 year after the last class attended.

  • Marketing Data: Kept until you unsubscribe.

  • Medical Info: Deleted 30 days after the conclusion of the specific class/term unless you re-enroll.

You can request your data to be deleted sooner than these timelines per Section 8.

6. Children's Privacy

We provide services for children, but we only collect data from parents or legal guardians. We do not knowingly collect data directly from children under the age of 16. By registering your child, you confirm that you are the legal guardian and provide explicit consent for the processing of the child's data for the purpose of the class.

We do not register or record sensitive data volunteered by children during our classes and workshops.

7. Cookies

We use cookies to ensure our website functions correctly. These are created and maintained by our website provider Wix, subject to your cookie preferences. 

  • Essential Cookies: Required for the booking system and security.

  • Marketing/Analytics Cookies: Used to understand site traffic. These are only activated if you click "Accept" on our Cookie Banner.

8. Your Rights (GDPR)

Under the GDPR, you have the following rights:

  • Right to Access: You can request a copy of the data we hold about you.

  • Right to Rectification: You can ask us to correct inaccurate information.

  • Right to Erasure ("Right to be Forgotten"): You can request that we delete your data.

  • Right to Withdraw Consent: You can opt-out of marketing at any time.

9. Third-Party Disclosures

We do not sell or trade your personal information. We only share data with:

  • Website and payment service providers, such as Wix.com,

  • Analytica and marketing providers, such as Meta, Google, and others,
